Governance

The Hamlets Act provides the legislative foundation for municipal government in Nunavut's 24 hamlets, setting out the powers, responsibilities and authorities of councils and municipal administrations.

NAM is working to ensure that the experience of Nunavut's municipalities is reflected in the review of this important legislation.

By bringing together feedback from hamlets, municipal leaders and administrators, NAM can identify provisions that may no longer reflect how communities operate today, areas that create challenges or uncertainty, and opportunities to strengthen the legislative framework for local government.

The review provides an opportunity for municipalities to have a collective voice in shaping legislation that is practical, understandable and responsive to the realities of governing and delivering municipal services in Nunavut.

The Bylaw Review initiative helps Nunavut municipalities learn from one another by making bylaws from other communities easier for SAOs and Mayors to find and review.

When a community needs to update an existing bylaw or develop a new one, seeing how other Nunavut municipalities have addressed the same issue can provide a useful starting point.

Access to examples can help municipal leaders identify different approaches, consider what may work in their own community and reduce the need to begin every bylaw development process from scratch.

By bringing municipal bylaws together as a shared resource, NAM is helping communities share knowledge, strengthen local governance and make better use of work that has already been done across Nunavut.

The Planning Act provides the legislative framework for land use planning and development in Nunavut, influencing how communities plan for growth, manage land and make decisions about future development.

NAM participated in the review of the Planning Act to ensure that the experience and practical realities of Nunavut municipalities were reflected in the proposed legislation. NAM reviewed the draft legislation from a municipal perspective and provided comments and recommendations on provisions that could affect local planning, development processes, municipal responsibilities and the ability of communities to respond to their own needs and priorities.

The review was particularly important because planning decisions are closely connected to many of the challenges municipalities are facing today—including housing, infrastructure, community expansion, land availability, climate and environmental risks, and economic development.

By providing a collective municipal perspective, NAM worked to ensure that the legislation is practical, understandable and workable at the community level, and that municipalities have an appropriate role in decisions that directly affect the future development of their communities.

NAM's participation also reinforces an important principle: legislation affecting municipalities should be developed with municipalities, drawing on the experience of the people who must ultimately work with and implement it.

The Policies & Guides initiative provides Nunavut municipalities with practical policy resources that councils can adapt to meet the needs of their own communities.

Each resource brings together a sample policy with a companion guide for council. Rather than simply providing a policy template, the guide helps council members understand the issue the policy is intended to address, the relevant legislative requirements and the questions they should consider before making a decision.

The initiative helps communities avoid starting from scratch while supporting informed local decision-making. Councils can use the resources as a starting point, discuss how the policy should work in their own community, and adapt it to reflect local needs and circumstances.

Over 20 policies and guides are available for the SAO and staff use.
